
PETZL is organizing a free contest on the Internet, no purchase necessary, called "TIKKA² – The Power of Light". You can enter the contest from November 1st 2009 to December 31st 2009.
This contest is open to any person aged 12 or more, of any nationality, living in a country where taking part in a Web contest is allowed.
Participation is limited to one single entry (photo or video) per home (same name, same postal address) for the duration of the contest.
To take part in the contest, Participants must submit a photograph OR a video (2 minutes maximum) on the topic: "Illustrate the power of light with a photo or a video", or more precisely "Of what use is a light at night?" or "What do you do with your headlamp?"
Regarding the MUSIC for videos, the Organizing Company will provide 100 pieces of music to be downloaded in the MUSIC section.
The jury will judge the videos ans photos based on criteria of originality, humor, quality and aesthetics.

(hereinafter "the Organizing Body") is organizing a Contest on the Internet, which is free and without obligation of purchase and named "TIKKA² - The Power of Light" (hereinafter the "Contest"). The Contest will take place from 1st November, 2009 to 1st March, 2010.
The rules of the Contest are contained in the present document, completed and/or modified by any appendices that the Organizing Body could, if necessary, add without making it responsible in any way in this regard and without any damages being claimed on the part of the Participants (hereinafter, "the Rules").
This Contest is open to any person over 12 years of age (consent of legal guardian compulsory for minors: In this case, please send your consent by mail to the above address, to the attention of "service Jeu Concours TIKKA² "), of any nationality, whose residence is located in any country where participation in a contest is authorized (hereinafter the Participant). Persons not filling the above conditions are excluded, as are members of the staff of the Organizing Body, and all persons implicated in the organization of the Contest as well as members of their families (parents and children). The Organizing Body reserves the right to ask any Participant to prove his eligibility based on the above conditions. Any person not fulfilling these conditions or refusing to prove them shall be excluded from the Contest and shall not, in case of a win, receive a prize. Participation is limited to a single contest (photo or video) per household (same name, same mailing address) for the entire duration of the operation. Access to the Contest requires the presence of Flash ™ plug-in version 9.0 or higher from Adobe ® in the user's navigation system. A Participant not in possession of this plug-in and not willing to download it shall not be able to access the Contest. It is specified that the Internet user who does not possess this plug-in may nevertheless download it free of charge. Since it is not the publisher of this computer software, the Organizing Body the Participant accepts that it is not responsible for any manufacturing defect, malfunction, incompatibility with other computer software installed on the hard drive of the Participant's computer, nor in the case of loss or alteration of any data belonging to the Participant. (Adobe ® and Flash ™ are brand names or registered trademarks of Adobe, Inc., in the United States and/or other countries).

The Participant shall register for the Contest by completing the registration form provided online, where he will include all necessary information required for his registration and notably his family name, first name and a valid email address. Furthermore, in order to validate his registration, the Participant must check the box confirming acceptance of the present Rules without reservation or modification.
The Participant is informed and accepts that all the information provided on the registration form is proof of his identity. The information provided by the Participant bind him after being validated.
The Participant agrees to complete the provided registration form in good faith and to provide accurate information to the Organizing Body. The Participant must complete all boxes identified as compulsory. Any inaccurate or incomplete registration shall not be considered and will annul participation. The same sanction will apply in the case of multiple registrations.
The Organizing Body may, at its sole discretion, determine whether the Creation respects these terms and conditions and may decide to publish it or not.
To participate, the Internet user must:
Creations are submitted for inspection by the Organizing Body, which shall inform the Participant by email regarding the publication (or non-publication) of his/her Creation on the Site. Creations accepted by the Organizing Body shall be put online within a maximum of 10 days from their date of submission.
The Participants are divided into 2 categories, depending on their type of Creation: "photo" or "video".
"VIDEO" category
PUBLIC VOTE:
Creations are submitted for voting by Internet users for a period of 14 days from the date they are put online. Internet users may vote from 1st November, 2009 to 14th January, 2010.
Each Internet user may vote only once per day per Creation.
The scores, represented by stars, go from 1 to 5. A score of 5 is considered the top score. The ranking of a Creation will count starting from the 20th vote from the public.
An average of all the scores given by the public will be calculated and shall determine the 4 top videos as determined by the public. Any scores entered directly via the Youtube website will not count in the final average. These 4 top videos will receive points according to their ranking:

The video jury is composed of the following people:
The judges mark the videos according to the criteria of originality, humor, performance or esthetic quality. Each of the 4 members of the jury will rank his 4 preferred Creations in descending order. The 4 highest-ranked videos from each judge will receive points according to their ranking:
RESULTS:
The final result is the total of the public vote and the jury vote.
The Creation receiving the highest total number of points will be designated the winner of the competition. The 3 other winning Creations shall be determined based on their number of points. In case of a tie between several Creations, the 4 members of the jury will make the final decision on their ranking. This decision shall be carried out by a vote by the 4 judges, with the President of the jury having the casting vote over the other members of the jury. His vote will count for double to separate several Participants in a tie. The authors of the 4 winning Creations will receive 1st to 4th place prizes, depending on the total points obtained.
ADDITIONAL PRIZES:
Each week, the public votes will be counted. The 5 Creations with the highest ranking of the week will receive a prize (5th to 50th place). The authors of these Creations will win a TIKKA PLUS headlamp2(see Article 7 - Prizes)

The final results shall be announced March 1, 2010, and the 8 winners of the Contest will be revealed (4 winners in the "photo" category and 4 winners in the "video" category).
The winners will be contacted by email when the voting is completed, and they must then, within 10 days, complete and return the shipment form in order to receive their prizes.
The first prize in each contest shall be given by the Distributor of the Organizing Body that is closest to the winner's place of residence. The winning Participant must then go to the Distributor of the Organizing Body to be weighed and to choose the precise content of his prize. The round trip will be paid by the Organizing Body. The Organizing Body shall conclude a transportation contract for the benefit of the winner with a travel agency, and under no circumstances can the Organizing Body be associated with the travel agency in question, nor with the transporter, who shall alone be responsible for the conditions of execution of the travel contract. The responsibility of the Organizing Body shall therefore not be engaged in this regard. The chosen Prize shall then be sent to the Participant at the expense of the Organizing Body.
The 2nd to 4th prizes of each contest shall be sent to the winners within approximately 3 months from the date of reception of the last shipment form.
The 5th to 50th prizes of each contest shall be sent to the winners within approximately 2 months from the date of reception of the last shipment form.
All incomplete, incorrect and/or illegible shipment forms shall be void and participation will be cancelled.
The prizes won by the Participants may not be returned, nor exchanged, nor converted to cash, nor transferred to another person.
However, the Organizing Body reserves the right to replace the prize offered with a replacement prize of equivalent nature and equal value.
The risks associated with transport of the prize are carried by the winners who, in case of deterioration and/or missing prizes at the time of reception, renounce any claims for damages to this effect from the Organizing Body.

The value of prizes is determined at the time of writing of the present document and shall not form the object of a challenge as to its evaluation. The calculation of the weight of the products is generated from Petzl's computer data. The total weight of the products, as well as the maximum authorized value, are based on the France 2010 Base Price.
The above prizes awarded to winners may not be grounds for any dispute of any kind, nor for any awarding of their monetary value in cash, nor for their exchange or replacement for any reason whatsoever.
The names of the winners will be available by the Organizing Body at the end of the operation. The prize is nontransferable and may not be awarded to another person.
No document or photograph related to the prizes is contractual. The Organizing Body reserves the right to substitute, at any time, for any of the proposed prizes, a prize of an equivalent nature and equal value, without engaging its responsibility in this regard and so that this substitution does not open the right to any compensation for the profit of the winners.
The Organizing Body shall not be held responsible for delays and/or losses during the process of the postal services or transporters, nor for total or partial destruction of prizes by this type of transport or in case of malfunctioning of these services, or for any other case of accident.
If the winner is not reachable at the end of the voting period, his prize shall not be awarded.
The obligations and guarantees listed below apply to all transmission of Creations that Participants will make in the context of the Contest.
Each Participant hereby authorizes the Organizing Body to use and air on the Site for viewing by others the Creation that he makes available to the Organizing Body in the context of the Contest. This authorization is valid for the entire duration of the Contest as well as for the durations and territories specified below. The Organizing Body agrees to never sell all or part of the Creations (photos, videos, music). This authorization does not impart any right to any remuneration or benefit whatsoever, nor any other right to Participants.
Transfer of rights to the Organizing Body's Site (http://www.youtube.com/user/petzltikka2) during the entire duration of the Contest (from 1st November, 2009 to 1st March, 2010), in order for the Creation to be subjected to evaluation by the public and the juries. During this period, it is possible that the Creation be integrated into other Internet sites with the <embed> function.
A contract for transfer of copyright, mentioning the free and exclusive character of the transfer will be concluded with each of the winners, whose Creation the Organizing Body will intend to use for promotional purposes, in accordance with the intellectual property code. For this reason, the prizes shall be remitted at the moment of signing of the contract transferring copyright .
The winners formally accept to reserve exclusivity of their Creations to the Organizing Body for the entire duration of the transfer, excluding all other persons, physical or moral, who may solicit them. Each winner whose Creation is used by the Organizing Body may demand that his/her name appear on the Creation. Each winner accepts that his/her Creation be modified at the beginning and at the end of the video in order to add the logo of the Contest and Internet site (http://www.tikka2.com). The Participant agrees to provide the Creation in the highest definition possible, at the request of the Organizing Body.
The Organizing Body reserves the right to use the Creation in the following media:
The Participants thus expressly accept that their Creation may be freely encoded and aired via the servers http://www.youtube.com (http://www.youtube.com/user/petzltikka2 / http://www.youtube.com/user/petzlcrew) and http://www.dailymotion.com (http://www.dailymotion.com/Petzl-crew), non-restrictive list.
Transfer of rights to the Sites of the Organizing Body and its partners (distributors, retailers, community websites, Flick-R, non-restrictive list) during the entire duration of the Contest (from 1st November, 2009 to 1st March, 2010), in order for the Creation to be subjected to evaluation by the public and the juries. During this period, it is possible that the Creation be integrated into other Internet sites with the <embed> function.

The Participants thus expressly agree that their creations may freely be redirected toward other community Internet sites, and notably www.facebook.com (http://www.facebook.com/Petzl) www.flickr.com (http://www.flickr.com/photos/petzl-sport/), non-restrictive list.
Thus, each Participant recognizes that the Organizing Body is not able to prevent subsequent use, modification, alteration, etc. of Creations affected without authorization by a third party.
The racist, pornographic, violent or injurious nature of certain content, civil liability, inappropriate rope technique or incorrect manipulation of equipment that puts the lives of persons in peril, and disrespect of author or image copyright are reasons that may lead the Organizing Body to not publish the Creation, to pull it from the Site and to disqualify the Participant. This list is neither complete nor limited.
Each Participant guarantees to the Organizing Body the free and peaceable exploitation of the copyright ensuing from the Creation for the duration of the Contest. The Organizing Body refuses all responsibility in case of non-respect by Participants of these agreements.
The guarantees agreed to in the terms of Article 8 are agreed to for the entire duration of the Contest, and continue after its conclusion until the date of prescription of any legal action and/or claim that may be exercised over the Creations.
In case of non-respect of these agreements, each Participant agrees to pay all costs, damages and interests, transactional amounts, reasonable legal counseling fees, preamble by the Organizing Body, relative to any possible legal action taken by a third party, notably on the cause of these latter rights and implicating the Participant.
Each participant agrees, in any way possible, to provide all the help and information required in the context of an action that has been taken against the Organizing Body.
The participants having received a Prize agree to not resell their prizes in another way, notably on the Internet, in a distribution network or at any other sales location.
The Organizing Body reserves the right to shorten, extend, modify or cancel the present operation in the case of a major force that would render it impossible to continue the Contest in accordance with the disposition of the present Rules and notably in case of a dysfunction of the Internet or of any other problem related to the telecommunications networks, or computers online, of servers, of Internet providers, of computer equipment or software, without any responsibility being engaged in this regard and without any compensation whatsoever being claimed by the Participants.
Under the hypothesis of such a cancellation, modification or extension occurring, the Organizing Body agrees to inform all the Participants by email and, in this case, to communicate the new rules to which they must submit themselves as appended to the present ones.
The Organizing Body shall not be responsible for damages, direct or indirect, whatever their cause, origin, nature or consequence, even if it may have been advised of the possibility of such damages, provoked by reason of:
Any Participant may ask for a refund of connection costs related to his/her participation in the Contest corresponding to the cost of seven (7) minutes of connection time (only one reimbursement per Participant, regardless of how many times the Participant connects). The reimbursement will be calculated pro rata from the Participant's payment, upon presentation of proof sent to the address of the Organizing Body.
Any request for reimbursement must be sent exclusively by mail to the following address:

The request must contain the reason it is being sent, the title of the Contest and the title of the Creation (specifying "photo" or "video"), the full name of the Participant, as well as the receipt proving an Internet connection from which the Participant connected to the Site, his/her email address and his/her mailing address, as well as the date and hour at which he/she was connected in order to participate in the Contest.
The request must be accompanied by proof of the incurred costs and banking information, as the reimbursement will made through a bank transfer. Postage fees will be reimbursed at the current regular mail rate (France and International) (20 gram base), i.e. 0.51€ in France.
The request for reimbursement shall be reimbursed at the same address upon request.
The Organizing Body does not take responsibility for:
Participation in the Contest implies acceptance of the present Rules that is irrevocable and without reservation. In case of a dispute or claim for any reason whatsoever, the requests must be written by hand and sent to the attention of PETZL DISTRIBUTION - Service Jeu Concours TIKKA² - 132 rue du pré blanc - Cidex 105 A - 38920 CROLLES - FRANCE, within 30 (thirty) days after the end of the Contest. The Participants agree, in case of a difficulty that may occur with regard to the application or interpretation of the present Rules, to make an amicable appeal to PETZL DISTRIBUTION - Service Jeu Concours TIKKA² - 132 rue du pré blanc - Cidex 105 A - 38920 CROLLES - FRANCE, before taking any legal action against the latter. The present Rules are subject to French law.
In accordance with law N°78- 17 of 6th January, 1978, named "Informatique et Libertés" ("Computers and Freedoms"), the Participant is informed that certain responses identified as such on the registration form may be optional, while it is at the same time stipulated that any default in responses to required questions leads to non-participation in the Contest. The collection by the Organizing Body of any personal information concerning the Participant is intended to ensure the good functioning of the Contest. At the end of the Contest, the information will be destroyed and not used, and no marketing process shall be undertaken by the Organizing Body.
Participants may at any time make a request for correction or withdrawal of their information by sending an email to: info@petzl.fr or by sending regular mail to PETZL DISTRIBUTION - Service Jeu concours TIKKA² - 132 rue du pré blanc - Cidex 105 A - 38920 CROLLES - FRANCE.
Each Participant also has the right to access, correct and withdraw the information concerning him/her. Postage costs at the current regular rate will be reimbursed to any person requesting it (see Article 12).
